LOGS and their preservation are an essential element to VPN, a major factor when choosing your VPN service.

A VPN connection offers secure access to the internet and renders you « anonymous » on the internet thanks to an IP address that is not registered to your home, but to your VPN provider. But you need to remember that VPN providers are also businesses with legal obligations which provide an online service in exchange for compensation. Which means that a VPN service may eventually keep a record of its connections, or Logs.

LOGS are data concerning your activity. There are two types:

  • User Activity or Activity Logs. Also called monitoring, it means keeping data linked to your activities (searches, pages visited). To my knowledge, no VPN actually does this.

  • Session Data or Connection Logs: total bytes transferred per session (data usage totals), source IPs and timestamps (connection start/end time). These logs are necessary from a technical point of view, for eventual help (Support). These LOGS link your personal IP and the one used by the VPN. When VPNs talk about NO LOGS, they are referring to this kind.

LOGS depend on four things:

  • The VPN itself. They can choose to apply the regulations of the country that hosts their HQ, and preserve their LOGS as long or longer than required.
  • if VPN provider doesn't log it doesn't mean that the data center they use may not: Data Center and VPN
  • The jurisdiction the company is based in. Also the server used and jurisdiction of it: The choice of server location is particularly important because legislation can apply to both the business HQ and the servers.

  • The country's laws. Each country has a law for the preservation of data and for whom it applies (ISP or a telecom provider or VPN). There are 3 categories:

    • USA. Although some people believe otherwise, the USA does not have any laws for the preservation of data. Which means the many VPNs situated in the USA can be NO LOGS and still respect the law. However the government may obtain (Stored Communications Act ) from service providers to preserve (without disclosing) for a limited period of time, any data which already exists within their network architecture and which relates to a specific investigation. The law requires preservation for 90 days, renewable for another 90 day period.

    • “Offshore” countries like Panama, British Virgin Islands, Seychelles, Belize, Argentina, Brazil, Ukraine, Hong Kong. These countries are also NO LOGS by the absence of any regulation. VPNs based there also enjoy fiscal advantages.

    • European Union. A more complex case. In theory, the 28 states that make up the EU should apply the EU Data Retention Directive (2006/24/EC) from 2006 in their own countries.. According to the directive (even if VPN services are not explicitly mentioned, they are clearly concerned), member states will have to store citizens' telecommunications data for a minimum of 6 months and at most 24 months. But the reality is more complex. This directive was recognised as invalid in April 2014 but there is one problem: it may have disappeared on a European level, but legislation – adopted following the execution of the directive – remains on an individual level for each state. Just because the directive is now invalid, national legislation is not necessarily changed: The fact that the original directive has been declared invalid does not automatically invalidate the corresponding national legislation. In these cases:

      • Germany: In Germany Privacy Laws is optimal. The only country that never adopted legislation in the first place. The German Constitutional Court did not consider data retention unconstitutional as such, but found the law transposing the Directive to be unconstitutional since it did not sufficiently limit the circumstances in which law enforcement authorities could access the data, and did not contain sufficient measures to protect retained data against breaches of confidentiality (data security).

      • UK: A new law was quickly adopted in July 2014. The DRIP Act replaces previous UK regulations on data retention that had implemented an EU law (retention period may vary subject to a maximum 12 months). In addition, the UK published draft Data Retention Regulations, setting out what information must be included in retention notices.

      • Sweden: Initially, the Swedish authorities for Post and Telecommunications decided temporarily not to pursue internet providers that erased the metadata they collected. Then recently they seem to have regressed.  In Sweden, Data retention law not applicable to VPN providers (only to ISPs and phone operators)

      • In July 2014, Austria, Slovenia and Romania (in Romania Data retention law was not applicable to VPN providers, only to ISPs or telecom provider) declared the directive anti-constitutional. Slovak Constitutional Court Suspends Data Retention Legislation. The Czech Republic, Hongry, Cyprus and Bulgaria ho had already done the same long before were happy with their decision.

      • Lithuania, Denmark, France, Italy, Spain, Belgium, Ireland, Netherlands (That Data retention law is only for ISPs, not for virtual ISPs), Estonia, Greece, Latvia, Poland, Malta, Portugal, Croatia: Data retention is here to stay despite the CJEU ruling.

      • Finland, Norway (not a member state of the EU), Luxembourg (Data retention law not applicable to VPN providers). These governments decided to abandon the directive on data conservation and have begun working on new laws.

      • Countries outside the European Union such as Suisse (Swiss Federal Council said in a reply to a motion that the European Court ruling on data retention has no affect on Swiss laws,said Inside-IT.ch. Currently, metadata must be stored for six months in Switzerland for possible law-enforcement purposes. The revisions would expand both the scope of the surveillance and the duration to 12 months), Serbia and Iceland have also adopted data retention laws (even though it doesn't directly concern VPN)

5 points to note:

  • Don't forget you have absolutely no way to know for sure how safe a “No logs” claim really is. The famous example of EarthVPN

  • The following is a list of VPN service providers that claim they do not log activity nor IP information of their users. This is a short list compared to the total number of VPNs available on the market. VPNs that call themselves NO LOGS are not actually very common.

  • Some VPNs that do call themselves NO LOGS are also absent, since we are sceptical about some of them and so preferred to omit them from the list.
    • IVPN: calls itself NO LOGS even though based in Malta (for fiscal reasons) which transposed the directive (2006/24/EC) into national law
    • AirVPN: also states NO LOGS when based in Italy which strictly applies the European directive (2006/24/EC). To ensure genuine NO LOGS use the option VPN over TOR which avoids the legal problem.

  • Always read the VPN Privacy Policy. Each VPN applies its own policy.

  • It is best both to choose a VPN provider from a NO LOGS country and simultaneously to select local servers based in NO LOGS countries. This will guarantee NO LOGS no matter what, giving you a much higher level of confidentiality.
